Terms of Service
Devadesign is a freelance web designer, and devadesign.biz is in no way part of myspace.com or myspace.com employees. This is a legal agreement between you (Client) and devadesign (DD). By accepting DD Terms of Service (TOS) electronically or in any other way, you agree to the following:
1. Your electronic acceptance of these TOS shall have the same force and effect as if you had agreed to these TOS in writing. By agreeing to these terms, you are allowing devadesign to place their link on the bottom of your completed web page or copyright logo on your copleted Myspace page. Client herby gives permission to DD to use samples, screenshot of, or links to Client’s custom Website designed by DD for marketing and advertising purposes, including but not limited to use in our online client portfolio.
2. Recognizing the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable Content. Specifically, you agree to comply with all laws regarding the transmission of technical data exported from the country in which you reside.
3. From time to time third parties may offer service to DD Clients. Use of such third party services will be at your own risk and subject to the terms and conditions of those third parties. DD does not represent and warrant that use or access to any third party services will be compatible, uninterrupted, error free, without defects or that you will be able to access DD‘s Service. You also agree that DD is under no obligation to provide you with any enhancements, updates, or fixes to make DD’s Service accessible through any third party applications. Without limiting the foregoing, under no circumstance shall DD be liable for any delay or failure in performance resulting directly or indirectly from acts of nature, forces or causes beyond its reasonable control, including without limitation, Internet failures, computer equipment failures, telecommunication equipment failures, other equipment failures, electrical power failures, accidents, storms, governmental actions, orders of domestic or foreign courts or tribunals, or performance of third parties.
4. In case that your web domain goes unstable, you have to contact your web domain provider about that, not devadesign! DD will not be held responsible for changes to the myspace.com database and/or profile codes. You understand that any downtime or sudden change to the way your profile is displayed is not a fault of devadesign, but a result of myspace.com upgrades. You are aware that no refunds will be given whatsoever if these changes occur.
